Terms & Conditions

The Terms & Conditions in Section A) below (EXPERIENCES - TERMS & CONDITIONS) apply to all orders received for Experience gifts featured by Allpresent Limited, including but not limited to Experiences featured on its website.

For Non-Experience products featured by Allpresent Limited in other areas such as Flowers, Chocolates, Drinks, Bakery, Beauty, Hampers etc; please proceed to Section B) below, (GENERAL TERMS & CONDITIONS). These General Terms & Conditions also apply to orders received for Experiences in addition to the specific Terms & Conditions for Experiences contained in Section A.

Section A) - EXPERIENCES - TERMS & CONDITIONS
1. Suppliers
All Experiences featured by Allpresent Limited including, but not limited to Experiences featured on its website, are provided by third party suppliers who are neither employed by, nor acting as agents of Allpresent Limited. Allpresent Limited and its website are not linked to, connected with, responsible for or liable for any Experiences organised by these third party suppliers.

This means that the contract for any Experience purchased is directly between you and the third party supplier and that Allpresent Limited has no contractual liability to you whatsoever in respect of the Experience purchased for which the third party supplier shall be solely responsible. Experiences featured are subject to the third party suppliers' own terms and conditions governing the contract, a copy of which is available on request.

Allpresent Limited does not accept liability for any act or omission or negligence of a third party supplier including damage to property and consequential loss, death or injury, nor any other liability arising out of the provision of Experiences to you or to any other participant nominated by you.

In no circumstances shall the total liability of Allpresent Limited for any claim exceed the reasonable direct costs for the Experience voucher or product giving rise to such claim. Total liability shall in any event be limited to the value of the Experience voucher or product supplied by us to you, or to any other participant nominated by you, pursuant to your order.

2. Insurance
Where applicable, details of any insurance cover are included in the Experience voucher pack. It is your responsibility, or the responsibility of any other participant nominated by you, to make absolutely certain that insurance cover is adequate.

3. Representation
Details of each Experience featured by Allpresent Limited including, but not limited to Experiences featured on its website, are given in good faith and are consistent with information notified by the relevant third party supplier. Our third party suppliers reserve the right to make minor changes to an Experience on the day to maximise your safety and enjoyment. The images shown are intended to provide a general impression of the Experience described and do not form part of any contract.

4. Experience Voucher Validity
Experiences are supplied in a voucher gift pack which normally remains valid for at least 9 months. Vouchers within the expiry date can be extended once by six months on payment of an additional handling fee. Please contact us for further details.

5. Fitness & Qualifications
For safety reasons, some Experiences have age, size or health restrictions. Further information can be found below the main description of each Experience.

6. Duration
Timings are given as a guide only. You may be asked to wait between different elements of the Experience alongside other participants.

7. Weather
Some Experiences are weather dependent. The supplier information sheet in your voucher pack advises if you should call to check conditions before participating. If your event is cancelled due to poor weather, it will be re-booked for a mutually agreed alternative date. We are unable to reimburse travel, accommodation or any other incidental expenses incurred in attending an Experience which is cancelled for any reason.

8. Problem Solving
In case of any problem on the day, please speak directly to the third party supplier organising the Experience who will try to resolve the issue immediately. If it cannot be resolved to your satisfaction at the time, please contact us within 24 hours of the event so we can pursue the matter further with the third party supplier.

N.B. All orders for Experiences are also subject to our GENERAL TERMS & CONDITIONS contained in Section B) below:-

Section B) - GENERAL TERMS & CONDITIONS

The following terms & conditions apply to all orders (including Experiences) received for products &/or services featured by Allpresent Limited, including but not limited to those products &/or services featured on its website:

a. Order Acceptance
The sale of products shall not be considered complete until we have accepted your offer to purchase them. Our acceptance of your offer to purchase is signified when we process and charge your credit or debit card. We reserve the right to decline your order at any time up until the moment we charge your credit or debit card.

b. Customer Order Cancellation
If you wish to cancel your purchases from us, you must contact us the day you first place your order. We will then advise whether production has already commenced or if the goods have already been dispatched. Providing we receive your notification before production has commenced or any item has been dispatched, we will cancel your order and you will not be charged. If we have started to process your order or it has already been dispatched, we will be unable to cancel your order straight away and the goods will be charged to you and sent to the requested address. Providing you cancel your purchases in writing within 7 days of order placement, refunds can normally be issued retrospectively for non-perishable and non-personalised items only. Please note that refunds exclude all delivery charges (both delivery charges to you and any return charges we incur). Refunds are also subject to a 20% handling fee to help offset bank processing commission, administration and labour costs already incurred. This does not affect your rights under the Distance Selling Regulations 2000. However, cancellation rights under these regulations do not extend to perishable and personalised items.

c. Prices
All prices shown are in UK Pounds Sterling and include VAT where applicable. We reserve the right at any time to revise prices to account for any increases in costs including, but not limited to, the increase or imposition of any duty, tax, levy or exchange rate variation. We will take all reasonable steps to notify you of any relevant revision of prices before processing your order.

d. Delivery
We will take all reasonable steps to deliver your order within the time indicated in our Delivery details. However, we will not be under any liability to you in respect of any failure to deliver within this timescale or on any particular day or dates. Adverse weather, carrier breakdown, road closure, non-contactable recipients and other factors may at times lead to transit delays. Title to the goods passes to you immediately before your consignment is delivered to our nominated carrier(s) for dispatch. If you wish to collect the goods personally, please e-mail us to this effect so that we can make the necessary arrangements. If your order is not received by the preferred delivery date you request or is not as described on our website, you must notify us in writing within five working days after the preferred delivery date. You must also ensure you receive a written acknowledgement from us within two working days after notifying us of non-receipt. This serves as your guarantee that we have received your notification of non-receipt and that we are investigating the matter further with our carrier. If our investigation shows the goods remain undelivered, we will - at our sole discretion - either replace or refund the item(s) in question. If our investigation shows your order was not as described on our website when received, we will - at our sole discretion - replace the item(s) in question. Within the UK, any delivery address you give when ordering will normally be checked against Royal Mail's database for accuracy. If the delivery address provided with your order is inaccurate or incomplete, we will be under no liability to you in respect of any failure to deliver your order to the intended recipient.

e. Ingredients
PLEASE NOTE: ALL FOOD & DRINK PRODUCTS FEATURED MAY CONTAIN NUTS AND ARE NOT SUITABLE FOR NUT ALLERGY SUFFERERS.

f. Returns policy
We want you to be delighted with your purchases from us. If your goods do not arrive in perfect condition, simply follow the instructions below. This does not affect your statutory rights under UK law. Our guarantee is valid providing you have complied with the following conditions:-
i. You inform us of your complaint by e-mail within 7 days of receiving your order
ii. At our request, you agree to return the goods in question to reach us within 14 days of the date you originally received them. Any goods returned must be unopened, in the same packaging and condition as you received them. For your own protection when returning items, please use recorded delivery - retaining your receipt - since we cannot process claims until the goods are back in our possession.
iii. You pre-pay the cost of return postage and packing including recorded delivery. We will refund this cost to you providing we are satisfied that the goods were either faulty when dispatched or were damaged in transit. We will give you beauty desses prom dresses online.
Subject only to section b. above (Customer Order Cancellation), we shall have no obligations or liabilities of any kind in respect of goods purchased from our website which are returned for any other reason or where the above conditions have not been followed. In such instances, we shall have the right at our sole discretion to refuse the return if in our opinion it is not justified. Under these circumstances, no refund will be made and the goods will be returned to you at your cost or retained if you do not wish to accept the cost of returning the goods to you.

g. Legal Liability - for Experiences, see also Section A) 1.) Suppliers above
The contracts for the sale of goods or services by Allpresent Limited featured on our website shall be exclusively subject to, governed by, construed and interpreted in accordance with English law. The courts of England and Wales shall have exclusive jurisdiction in respect of them and any disputes or claims arising out of or in connection with them.

Our liability to you whether for breach of contract, misrepresentation, negligence or otherwise shall in no circumstance exceed the reasonable direct costs for the damaged, defective or undelivered goods which give rise to such liability and shall in any event be limited to the value of the goods or services supplied by us to you pursuant to your order.

h. Acceptance of our Terms & Conditions
By placing an order for goods or services featured on any website owned by Allpresent Limited, you are deemed to have accepted all our terms and conditions as governing your order. If you do not agree to all the terms and conditions specified, you must not order from us.
